The name traces back to Stokes v. INS, a federal case involving the government's examination of a marriage for immigration purposes.

Today, immigration lawyers commonly use the term “Stokes interview” for a more intensive marriage interview in which spouses are questioned separately and their answers are compared for inconsistencies.

So what happens when the answers don't match?

“Stokes” did not begin as the government's name for a marriage test.

The 1975 case was brought by U.S. citizens and their spouses challenging the procedures INS used while investigating their marriages.

They raised questions about intrusive investigations, coercion, privacy and whether couples received a fair process.

A discrepancy is not the same thing as proof.

Married people forget things. They remember the same night differently. One knows the bank balance. The other barely knows which bank it is.

In an earlier federal marriage-fraud prosecution, DOJ said an immigration-fraud agency coached clients and spouses through USCIS interviews and advised them on maintaining the appearance of legitimate marriages.
